ACKLEY CITY COUNCIL met in regular session December 10, 2025 in the Ackley Council Chambers with Mayor Michael Nuss presiding.  The meeting was called to order at 6:00 pm.  Council members present:  Judy Crawford, Dan Scallon, Chuy Flores, Maliah Roelfs, Mike Abbas. Quorum present.

Scallon moved, Flores seconded to approve the December 10, 2025 agenda. Ayes-all. Motion carried.

Roelfs moved, Flores seconded to approve the Consent Agenda by one motion: a) November 12, 2025 Regular Minutes, as written.  b) Bills approval, as listed.  c) Place Reports on file:  November 2025 Clerk Bank Reconciliation/Cash Report/Treasurer; November 2025 Clerk Budget; November 2025 Deputy Clerk Utility Billing Reconciliation; November 2025 Fire; November 2025 Ackley EMS; November 2025 PeopleService; November 2025 Ackley Development; November 2025 Deputy Clerk Nuisance. Scallon moved, Abbas seconded to pass Resolution 25-44 Amending Current Budget for FY June 30, 2026. Roll call vote: Ayes-Abbas, Crawford, Scallon, Flores, Roelfs.  Motion carried.

Dennis reported City Attorney has not heard back from Prairie Bridges Park Board’s Attorney regarding the lease/agreement.  

No update on 2020A GO Bond street projects or Civic Center/Pizza Ranch roof lines.  

Ordinance No. 543 Amending Chapter 50 Nuisance Abatement and Chapter 51 Junk/Junk Vehicles was presented. Nuss shared concerns with how extremely inclusive the ordinance read. Nuss suggested to hold more than 1 hearing when adopting this ordinance, to be sure the residents are fully aware of the change.  

Discussion on FY27 budget to include Cougar’s Den, community beautification, moving APD reserve funds to Cap Proj Demo Fund to assist in zeroing the negative cash line, budget schedule, airport reserve, ambulance department, and health insurance options.

Ackley EMS EMR tuition was discussed. Dennis presented city funds spent on former volunteers to take the class, who ended up not completing the class or unable to pass the testing process and the city was not reimbursed roughly $3,400.  Nuss reported he had sent out letters to community members and stated the city would pay for the class. There would be an interview process with potential volunteers before the city pays tuition. Iowa Valley is required to give the class, rather than Thomas Craighton or Corey Larson, making the class more expensive. Once a person passes the class, the city can be reimbursed by the county. Scallon moved, Flores seconded to approve payment for class tuition from the ambulance reserve funds. Ayes-all. Motion carried.

Oath of offices were given to Nuss, Steven Ackerman, and Michael Wessels. Dennis presented all 3 with their certification of election.

Abbas moved, Roelfs seconded to set public hearing date to January 14, 2026 at 6 pm in the Ackley Council Chambers for Ordinance No. 543 Amending Chapter 50 Nuisance Abatement and Chapter 51 Junk/Junk Vehicles. Ayes-all. Motion carried.

Scallon moved, Roelfs seconded to approve Beer/Liquor License for Casey’s Marketing Company DBA Casey’s General Store #1921 Amendment and Lori’s Books, Inc DBA Perennial Pages Bookshoppe. Ayes-All. Motion carried.

Scallon moved, Roelfs seconded to approve payment to Forgy Electric in the amount of $5,615.44 for Well #2 controller installation. Ayes-all. Motion carried.

Flores moved, Roelfs seconded to approve payment to Ferguson Waterworks in the amount of $2,872.50 for annual maintenance fee. Ayes-all. Motion carried.

M. White, PeopleService, the water plant aerator tank has sprung a leak. This tank removes ammonia. White has been unable to find a contractor that is willing to fix the leak. White is currently applying JB Weld to the tank. White, L. Gallentine, CGA Consultants, and Nuss have been discussing options on what direction to go with the tank. Discussion on a new water treatment plant, installing a new aerator tank, or continue trying to find someone to patch the current tank. There is a 42-week lead time if a new tank is to be installed. Nuss to contact Jeff Kurth about a fabrication fix. Flores and M. Wessels to meet with White at the Water Plant on Friday to discuss some other options. Dennis informed Council of available water funds as well as a grant opportunity with Region 6, to coincide with a water revenue loan, in the event that a new plant is the only option.

L. Gallentine, waiting on the IDOT for the Franklin St N of the RR track street project.  No update on the Storm Sewer projects or the Bonded Street projects.  

Nuss gave Public Works monthly report. Department will be working on removing snow around fire hydrants around town.

Dennis reported the FY25 annual exam went well and is complete. The final report should be done in about a month. Frey training is progressing, continuing to work on budgeting, the new council members will need to stop at City Hall prior to their January 2, 2026 start date for paperwork, and thanked outgoing council members Flores and Crawford.

Scallon mentioned that MICA is looking for a council person to represent Hardin County on their board, if anyone was interested. Roelfs and Abbas thanked Flores and Crawford for their time serving the community. Nuss mentioned MLA training for the newly elected officials, informed Council on B. Kreimeyer’s retirement from the library, thanked outgoing and incoming council members, and mentioned the code of ordinance book.
