SPECIAL MEETING

November 24, 2020

ACKLEY CITY COUNCIL met in special session November 24, 2020 in the Ackley Council

Chambers with Mayor Pat Daggs presiding. The meeting was called to order at 7:00 p.m.

Council members present: Chuy Flores, Pat Hurt, Joe Wessels, Mike Abbas, and Judy Crawford.

Absent: None. Quorum present.

Wessels moved, Crawford seconded, to approve the November 24, 2020 Agenda as listed.

Ayes-All. Motion carried.

Motion made by Crawford, seconded by Wessels to approve the deputy clerk job description as written.

Ayes-All. Motion carried.

Discussion was had on the Sanitary Sewer Project Phase I regarding the change order # 9 which had a decrease in the amount of $44,045.00 for 115 feet of piping that was not done. Sharon from Municipal Pipe reported during mediation that she bid on line item units and not on the plan drawings so she is reporting she never bid on that particular footage to begin with. The mayor had reported that the City has currently spent roughly $6,000 on legal fees and if we choose to go to court, we could spend upwards of $75,000. During mediation, Municipal Pipe agreed to settle with payment of $31,272.50, which according to Mayor Daggs was splitting the difference. Wessels is not satisfied with the flow meter situation. Crawford also voiced concerns with what happens after final payment is made and we have problems with the flow meter again. Motion made by Wessels, seconded by Abbas to pay Municipal Pipe $31,272.50 with the requirement that installation of the flow meter be done and working properly. Ayes-All.

Motion carried.

Motion by Abbas, seconded by Wessels to adjourn at 7:35 p.m. Ayes-All. Motion carried.
